Terms of Service Agreement This Terms of Service Agreement (the "Agreement") is a legal contract between you ("Customer") and GCG Homes & Investments ("Company") governing the use of our services. Accuracy of Information: Customer shall provide accurate and complete information required for the provision of services. The Company shall not be held responsible for any delays, errors, or damages resulting from inaccurate or incomplete information provided by the Customer. b. Compliance with Laws: Customer shall comply with all applicable laws, regulations, and codes related to the use of our services. c. Maintenance and Repairs: Customer is responsible for the routine maintenance and repair of the property, unless otherwise agreed upon in writing. 4. Intellectual Property: a. Ownership: The Company retains all intellectual property rights related to its services, including but not limited to trademarks, logos, and copyrighted material. b. Restrictions: Customer shall not use, modify, distribute, or reproduce any intellectual property belonging to the Company without prior written consent. 5. Liability and Disclaimers: a. Limitation of Liability: The Company shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of our services. b. Warranty Disclaimer: The Company makes no warranties, expressed or implied, regarding the accuracy, reliability, or suitability of its services. The Customer acknowledges that the use of our services is at their own risk. 6. Termination: a. Customer Termination: Customer may terminate this Agreement by providing written notice to the Company. Any fees or charges incurred prior to termination shall remain payable. b. Company Termination: The Company reserves the right to terminate this Agreement at any time, with or without cause, by providing written notice to the Customer. 7. Confidentiality: a. Non-Disclosure: Both parties agree to keep confidential any proprietary or confidential information disclosed during the course of providing services under this Agreement. b. Exceptions: The obligation of confidentiality shall not apply to information that is publicly available, rightfully obtained from a third party, or required to be disclosed by law. 8. Governing Law and Jurisdiction: This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction where the Company is registered. Any legal actions or proceedings arising out of or relating to this Agreement shall be brought in the competent courts of that jurisdiction. 9. Amendments: The Company reserves the right to modify or amend this Agreement at any time. Any changes will be notified to the Customer via email or by posting a notice on our website. Continued use of our services after such modifications constitutes acceptance of the updated Agreement. 10. Entire Agreement: This Agreement constitutes the entire understanding between the Customer and the Company and supersedes all prior agreements, whether written or oral, regarding the subject matter herein.
